Accommodation Terms and Conditions 

1. Company Details

Molly Morgan Wines Pty Ltd ACN 671 946 213 trading as “Molly Morgan Wines” 

Reference to “Molly Morgan Wines” in these terms and conditions is a reference to Molly Morgan Wines Pty Ltd ACN 671 946 213. 

2. Scope & Agreement

These terms and conditions (the “Terms and Conditions”) together with our Privacy Policy govern the relationship between Molly Morgan Wines and any individual who uses this website or utilises our accommodation services (other than the owners of the Properties), including but not limited to an individual who makes a booking at one of our Properties and each person named or travelling on that booking (each a “Guest” or “you”). 

2.1 Master/Source Terms

For additional, brand-specific terms and conditions, please refer to the detailed terms provided below. In the event that specific terms within the brand's terms and conditions do not reference the master/source terms and conditions as the basis, it should be understood that the master/source terms remain the overarching framework. 

2.2 Licence to Occupy 

Guests are granted a licence to occupy the Property for the booking dates. Guests are not granted a residential tenancy agreement under any residential tenancy legislation. 

2.3 Binding Agreement 

These Terms and Conditions constitute a legally binding agreement between Molly Morgan Wines and the Guest. You acknowledge that you agree to and are subject to these Terms and Conditions on behalf of yourself and all persons named or otherwise travelling on your booking. 

Molly Morgan Wines Pty Ltd may have additional terms and conditions (secondary to these terms & conditions) as outlined within this website and you need to read and adhere to them in conjunction with the overall Molly Morgan Wines Pty Ltd Terms and Conditions. 

The conditions outlined for “Molly Morgan Wines” are nuanced to supersede those that are generic within Molly Morgan Wines Holiday’s Accommodation Page. 

3. Definitions

Guest is the person(s) occupying the property for the purposes of Short-Term Rental. 

IMPORTANT: By making a booking and receiving a confirmation you agree to these Terms & Conditions. At the Guest Registration step, you will be asked to digitally confirm your acceptance.  

4. Occupancy Limits

The number of guests on the property must not exceed those agreed and paid for as part of the booking process, unless prior written approval has been obtained. This includes visitors and day trippers. 

This is a requirement of the NSW Government Code of Conduct which has financial penalties for both the Guest and the Owner. 

If extra guests/visitors are detected, Molly Morgan Wines may either: 

  • ask the extra guests to leave; OR 
  • evict the entire group at our discretion. 

5. Code of Conduct

5.1 Legal Requirements 

New laws have come into effect from 18th December 2020 which we are required to inform you of. You may read the Code HERE 

5.2 Guest Obligations 

The Code requires Guests to not at any time: 

  • make noise that is unreasonably disruptive or interferes with the peace and comfort of neighbours and other occupants; 
  • act in a violent or threatening manner; 
  • act in a manner that could reasonably cause alarm or distress to neighbours and other occupants; 
  • unreasonably interfere with the use or enjoyment of common property in a strata or community scheme; 
  • intentionally, recklessly, or negligently damage the personal property of neighbours or other occupants; 
  • copy or knowingly retain any keys or security passes at the end of occupancy. 

5.3 Local Compliance  

We ask all guests to observe local laws and be mindful of the peaceful enjoyment of neighbours and other residents. As the property is in a residential area, please keep noise to a considerate level. 

5.4 Breaches

Serious disturbances are taken very seriously and may result in immediate termination of your stay, with no refund and forfeiture of part or all of your bond if applicable, in line with legal requirements. Guests who breach the above Code will be placed on an Exclusion Register for 5 year resulting in a ban from being able to book any Short-Term Rental in NSW. We are required, by law, to enforce the Code of Conduct.    

6. Payments & Security

A 50% deposit is required to secure your booking. The remaining balance is due two weeks (14 days) before your arrival. 

For direct bookings with Molly Morgan Wines, the credit card used to pay your deposit will be saved (via a licensed e-merchant provider) and used to process any balance payment owing on the date that this balance is due. You will receive a reminder email regarding the remaining amount prior to your card being charged. 

Your saved card serves as a security measure during your stay. No funds are charged or held unless we need to contact you regarding any damage or additional cleaning fees incurred. 

All bookings are inclusive of guest service fees that may include transaction and booking fees, code of conduct administration fee, distribution and pricing optimisation fees, initial starter packs, linen and vendor administration fees, third-party technology fees, online travel agent commissions, incidental damage fee, etc. 

Fees are subject to change without prior notice. They may be applied as fixed amounts, a percentage of the total, or a combination of both. 

Some bookings may incur additional charges for services beyond our standard Terms and Conditions, as detailed on our website. These may include requests for extra linen, additional beds, or bed-making services, particularly when provided on weekends or public holidays. 

7. Check-in / Check-out

Your villa will be available from 2:00pm on the day of arrival. 

The property check out time is 10:00am on the day of departure, as confirmed in your booking.  

Late check-outs may incur an additional day's charge unless otherwise agreed in writing. 

If a cleaner is delayed due to late departure, a waiting fee may also apply. 

8. Guest Registration & Security Deposit  

To help us provide a smooth and secure stay, all bookings require a guest registration form. This form collects your full name, address, mobile number, and credit card details. For verification, we may also request a driver’s licence number. 

A security deposit may be required, ranging from 50%–100% of the total tariff. Deposits are refunded within 7–14 days of departure, depending on the booking platform used, and may be adjusted for any damages or breaches of these Terms and Conditions. Higher deposit amounts may apply for group bookings or at our discretion. 

Please note, non-compliance with these Terms and Conditions may result in immediate termination of your booking, with no refund of monies paid. Any deposit-related matters may incur a minimum $100 administration fee plus associated costs. By confirming your booking, you authorise us to charge for any breach of this clause. 

9. Occupancy & Guest Responsibilities

The property is let to the person 21 or older who makes the booking and is responsible for all guests (all guests must also be 21 or over unless otherwise agreed in writing). 

The property is intended for holiday use only, for the dates specified in your Confirmation, and for the maximum number of guests agreed with Molly Morgan Wines on your Booking Confirmation and Guest Registration form. 

We kindly ask that the property be left in a clean and tidy condition. If you use the BBQ, please ensure it is cleaned thoroughly; otherwise, a minimum cleaning fee of $50 may apply.  

All villas are non-smoking and pets aren’t permitted, so every guest can enjoy a fresh, relaxing, and welcoming space. 

10. Cancellation/Refund Policy:

We do require a deposit to secure all bookings. Please note that this deposit will be nonrefundable if the booking is cancelled after your deposit is received. 

Full payment for your booking must be received 14 days prior to your stay. If you cancel your booking within 14 days of your planned arrival, the full booking fee will not be refundable. 

If you have booked through a third-party platform, please be aware that the cancellation terms of that platform will apply, which may differ from Molly Morgan’s policy. 

To ensure we process your cancellation swiftly, we ask that all cancellation requests be submitted in writing. 

While we aim to ensure you have a great experience, please understand that booking fees cannot be reduced if your stay is shortened or the number of guests reduced, once your booking is confirmed. 

To offer you peace of mind, we highly recommend considering domestic travel insurance in case your travel plans need to change. 

11. Property Capacity & Safety

Each property is designed to comfortably accommodate a specific number of guests in line with Health Department regulations, and additional bedding, tents, caravans, or vehicles are not permitted; exceeding these limits may result in immediate eviction without refund, and by confirming your booking, you authorise us to apply any necessary penalties for breaches of occupancy. 

12.Provided Amenities  

Linen, towelling and basic toiletries are provided where specifically confirmed in writing. Please note linen must be used on all beds.  

Garbage Bins are provided with all properties. Please ensure that all garbage is removed from your holiday property and placed in bins provided. 

13. Caring for the Property

To help us maintain a welcoming and comfortable space for everyone, we ask that guests look after keys, remotes, and other property during their stay. If any items are lost, replacement charges may apply, including locks or remotes where needed. If you require extra keys outside standard hours, a small service fee will apply. Please never try to force entry if you’re locked out, and note that in some cases, guests may be responsible for costs to regain access. 

We also ask that guests treat the property with care. This includes avoiding damage, keeping common areas tidy, and taking care with furniture, appliances, and any provided items. If you notice any faults or breakages when you arrive, please let us know right away — this helps ensure your stay is seamless and avoids any misunderstanding about responsibility. 

In the rare event of damage or loss, we may need to deduct costs from the security deposit. This can include, but is not limited to, extra cleaning, repairs, removal of rubbish, unauthorised guests, noise disruptions, impact on neighbours, or late check-outs without approval. Furniture should remain in its place to keep the villa safe and comfortable for everyone. 

Finally, please help us keep the property secure throughout your stay. Guests are responsible for the property and any theft or damage that may occur. 

14. Personal Property & Liability

While we do everything we can to make your stay safe and enjoyable, Molly Morgan Wines and the owners cannot accept liability for any injury, debt, damage, loss, delay, expense, or inconvenience caused by events beyond our control. We also cannot take responsibility for guests’ personal belongings left on or near the property. 

We recommend that guests consider personal property insurance or suitable travel insurance to give peace of mind in case of unexpected situations before or during your stay. 

If you accidentally leave something behind, we’re happy to help you recover it where possible, but we cannot guarantee retrieval. Any postage, packaging, or staff time required to assist in returning items will need to be paid in advance, with a minimum cost of $50. Items of low value that are not collected will be disposed of after 14 days. 

15. Repairs & Nearby Work 

We may need to enter the property during your stay to carry out essential repairs or maintenance, and we thank you in advance for your understanding. 

If a tradesperson is called out at your request for a repair that is later deemed unnecessary, the cost of the callout may be on charged to you. 

Occasionally, renovation or building work may be happening in or near the property, and as the vineyard is a working farm, there may be times when machinery or equipment is in use. While this is beyond our control, we do our best to avoid operating machinery during early morning or late evening hours to minimise any inconvenience. Please note that we are unable to offer discounts for any disturbance or noise caused by such activities. 

16. Breaching Agreement

To help us maintain the property for all our guests, Molly Morgan Wines may use the holding security deposit (including any agreed credit card pre-authorisation) to cover any costs arising from a breach of this agreement, including but not limited to extra repairs, cleaning, or removal of excess rubbish. 

We kindly ask all guests to observe the house rules. Failure to comply may result in termination of your stay under the relevant laws, including the Innkeepers Act, with no refund of monies paid. 

17. Tariffs

Tariffs are subject to change without notice. 

18. Changes to Terms

The Company reserves the right to modify these terms and conditions at any time.
